Terms of Service

RedKey Digital provides custom web design, development, and SEO intelligence services through our proprietary NEXUS system. Services are delivered according to the plan selected by the client (Foundation, Growth, or Intelligence).

Web Design: Custom Next.js websites built, hosted, and maintained on Vercel. Sites are designed and coded by our team specifically for each client. We do not use templates or page builders.

SEO Intelligence: Continuous analysis through up to 25 NEXUS engines using data from Google Search Console, Google Analytics 4, Lighthouse, Bing Webmaster Tools, and WooCommerce (where applicable). Insights are implemented by our team as part of the ongoing service.

Hosting: Website hosting on Vercel is included in all service plans. This includes SSL certificates, CDN distribution, and automatic deployments.

All service plans are billed monthly in Australian Dollars (AUD) plus GST where applicable.

Foundation ($2,500/mo + GST): Custom website build (months 1-2), hosting, 12 core NEXUS engines, monthly reporting, email support.

Growth ($4,500/mo + GST): Everything in Foundation plus full 25 engines, 5 data sources, bi-weekly iteration, content strategy, priority support.

Intelligence ($7,500/mo + GST): Everything in Growth plus weekly iterations, dedicated strategist, client portal access, social ad generation, custom engine development.

Payment is due on the first business day of each month. We accept bank transfer and major credit cards. Invoices are issued via email.

Your content: You retain full ownership of all content, copy, images, and brand assets you provide.

Custom code: Code written specifically for your website is licensed to you for use on your domain. If you cancel and wish to take the site, we will provide the complete source code repository within 14 days of your request.

NEXUS system: The NEXUS engine system, its algorithms, and the underlying analysis infrastructure remain the intellectual property of RedKey Digital. You are licensed to benefit from NEXUS outputs during your active service period.

Third-party assets: Any third-party libraries, fonts, or services used in your website are subject to their own licenses. We only use assets with licenses compatible with commercial use.

To deliver our services effectively, clients are expected to:

Provide timely access to necessary accounts (Google Search Console, Google Analytics, hosting, domain registrar) during onboarding.

Provide content, brand assets, and feedback in a reasonable timeframe when requested.

Ensure that all content provided to us does not infringe on any third-party intellectual property rights.

Maintain active payment. Services may be paused after 14 days of overdue payment.

Notify us promptly of any issues, concerns, or changes in business direction that may affect the project.

Website uptime: We target 99.9% uptime through Vercel's infrastructure. Vercel's status page (vercel.com/status) provides real-time infrastructure status. Scheduled maintenance is communicated in advance.

Response times: Email support within 1 business day for Foundation, same-day for Growth, and within 4 hours for Intelligence plan clients.

NEXUS reporting: Monthly reports for Foundation, bi-weekly for Growth, weekly for Intelligence. Reports include engine outputs, implemented changes, and performance trends.

Implementation speed: Insights identified by NEXUS engines are typically implemented within 5 business days for Growth and Intelligence plans, and within 10 business days for Foundation.

Minimum term: 3 months from service start date. This allows time for website build (months 1-2) and initial NEXUS optimisation cycle (month 3).

After minimum term: Either party may cancel with 30 days written notice.

Cancellation process: Email cancellation to hello@redkey.au. We will confirm receipt within 1 business day.

Upon cancellation: Your website source code will be provided within 14 days of request. Domain ownership transfers immediately (domains are always registered in your name). NEXUS engine access ceases at the end of the billing period. Hosting continues for 30 days after final payment to allow migration.

Refunds: Prepaid months are non-refundable. Partial month charges are not prorated.

We treat all client data, business information, and analytics as confidential.

We will not share your data, results, or strategy details with any third party without your written consent.

We may reference your business as a client in our portfolio (e.g., on our Results page) with your permission. You may withdraw this permission at any time.

Our team consists of two senior strategists. No juniors, offshore teams, or third-party contractors access your data.

RedKey Digital provides web design and SEO intelligence services on a best-efforts basis. While we use data-driven methods and our NEXUS system to optimise results:

We do not guarantee specific search engine rankings, traffic volumes, or business outcomes. Search engine algorithms are controlled by third parties (Google, Bing) and are subject to change.

Our liability is limited to the fees paid in the 3 months preceding any claim.

We are not liable for losses arising from client-provided content, third-party service outages (Google, Vercel, etc.), or circumstances beyond our reasonable control.

We are not liable for any business decisions made based on NEXUS analysis or recommendations.

By using the RedKey Digital website (redkey.au), you agree to:

Use the site for lawful purposes only.

Not attempt to access restricted areas, interfere with site functionality, or reverse-engineer any part of the site.

Not scrape, copy, or republish our content without written permission.

Accept that the site may contain links to third-party websites over which we have no control.

These terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

We may update these terms from time to time. Updated terms will be posted on this page with a revised date. Material changes affecting active clients will be communicated via email with 30 days notice.
